The U.S. Supreme Court today set the date for its next arbitration argument.
It could be a big Federal Arbitration Act decision
The Court will hear Rent-a-Center West v. Jackson, 09-497, on April 26.
The question presented to the Court is whether the district court is required in all cases to determine claims that an arbitration agreement subject to the FAA is unconscionable, even when the parties to the contract have clearly and unmistakably assigned this "gateway" issue to the arbitrator for decision.
