Divergence in Global ADR Practice
Business is global. Dispute resolution is global. Practices are local. Laws vary from jurisdiction to jurisdiction, as do ethical rules, the role of inside counsel, the role of outside counsel and the effect of culture on the process. To succeed, businesses and their counsel must understand the impact location has on strategy and tactics. What works at home may not be as effective elsewhere. Worse yet, it may be illegal and/or unethical.
At CPR's 2014 Annual Meeting, attendees explored the impact of globalization on ADR practice, and the implications of divergence in ADR practices and processes around the world.
