Around the world, effective dispute resolution requires effective collaboration: between inside counsel and outside counsel, between business lawyers and litigators, between clients and counsel, and, ultimately, if resolution is to be achieved, among opposing parties and their lawyers. At its best, that collaboration begins long before any dispute appears on the horizon and enables the parties to tailor the basic elements of ADR to their specific business needs and create a framework to anticipate, avoid and manages disputes in a manner that minimizes the risk that the process will be prolonged – and costs multiplied – by disputes over the dispute process itself.
