Mediation Confidentiality: Can They Really Get the Mediator’s Notes? As mediators and practitioners, we often rely upon assumptions about the confidentiality of the mediation process. But recent developments, which will be explored in depth during this meeting, should cause us to question those assumptions. Our panel, featuring noted scholar Nancy H. Rogers, Professor Emeritus and Director, Program on Law and Leadership at Moritz College of Law, and mediator and practitioner Gene Farber, Partner at Farber, Pappalardo & Carbonari and Adjunct Professor of Law at Pace Law School, will explore the legal bases for asserting confidentiality, arguments against the presumption of confidentiality and practice tips to prepare for these challenges. Members will be encouraged to share challenges they have faced when mediation confidentiality is under attack and effective responses to these challenges.
