Commercial arbitration has come under increasing criticism for importing the disadvantages of court litigation – such as long and costly discovery periods, discovery motion fights, and drawn out hearings – without any of litigation’s attendant advantages.  If this trend continues, more and more parties will opt to fight out their complex commercial cases in court instead of arbitration, thus missing out on the myriad of benefits arbitration can offer. This VIP networking event will feature prominent inside counsel, outside counsel, neutrals and academics discussing the criticisms facing commercial arbitration today, the delicate balance between party autonomy and efficiency and offer innovative solutions for how clients, counsel, neutrals and arbitral institutions can best optimize arbitration to efficiently resolve disputes. The program will take place at the Pepper Hamilton’s Philadelphia offices and will be followed by a networking cocktail reception.
