Funding the Fight: Third-Party Funding & the Future of Dispute Resolution
With third-party litigation funding an increasingly important and unavoidable part of the litigation and arbitration landscape, this panel will offer a variety of perspectives on this phenomenon and the challenges and opportunities it presents for early dispute prevention and resolution. This insightful discussion will tackle the following questions:
(1) The basics of third-party litigation funding: What is it? How does it work? What do we know of its growing importance?
(2) How does litigation funding impact early dispute prevention and resolution, and how its effects might be mitigated in those contexts;
(3) The role of TPLF in arbitration; and
(4) Recent developments relating to third party funding, including case law, civil rule changes/proposals, and legislative developments.
