Guerilla Tactics in Mediation
This program will explore how “guerilla tactics” in mediation undermine not just a single negotiation, but the very foundations of the process itself. We will examine how behaviors such as strategic delay, participation without real intent to settle, withholding key information, emotional manipulation and personal attacks can corrode trust, distort outcomes and waste resources.
The session will then focus on what effective mediators can do in practice: early detection of red flags, setting and enforcing clear procedural and ethical boundaries, using caucus strategically to re‑orient parties towards genuine interests, and knowing when continuing the process risks legitimizing bad faith. The aim is to equip participants with concrete tools to safeguard mediation as a space of trust, professionalism and meaningful resolution, even when faced with highly adversarial or disruptive tactics.
