Program*: The panel will debate the combination of different dispute resolution methods, particularly the interplay between mediation and arbitration. Subtopics include (i) how to draft a med-arb multi-tiered dispute resolution clause: challenges and opportunities; (ii) mediation windows (a time set in the arbitral procedural schedule when the parties will discuss whether or not it could be useful to conduct a mediation); (iii) what other incentives could be used to foster the combination of mediation and arbitration and what are the main difficulties regarding such interplay.
