UNCITRAL Working Group II: Dispute Settlement, Days 3-4

Day 3 and 4 of the 79th session of the UNCITRAL Working Group II : Dispute Settlement took place this week at the United Nations, in New York. 


By Thursday Feb, 15, new drafts of the model clauses were produced and circulated on the 
•    model clause for highly expedited arbitration;
•    model arbitration for contracts with binding and enforceable arbitration;
•    model clause on technical advisers, and 
•    model clause on confidentiality.


The new drafts were circulating and will be posted when as the minutes are available. 
Nevertheless, the past two days were filled with discussions about parallel proceedings with a fear expressed that an adjudication and an arbitration could be open at the same time for the same matter--there could be an issue if there are two different rulings. Some delegates, however, did not see it as an issue. 


On Thursday-Day 4, Vietnam was elected rapporteur.
